These Regulations are effective as of June 6, 2025.
1. These Terms and Conditions define the rules and conditions for the provision of electronic services by Dangerous Goods Safety Advisor drs. D. Kociemba, with its registered office in Eindhoven, Spalaan 6, 5628 ZG, the Netherlands, KvK: 95907130, VAT ID: NL005178103B20 (hereinafter referred to as the “Service Provider”).
2. These Terms apply to services provided through the following internet domains (collectively referred to as the “Services”):
• adr.ac/eng/shop.html (Online Store);
• learn.hazmat.website (Moodle Platform);
• tickets.hazmat.website (osTicket System).
3. Any natural or legal person using the Services (hereinafter referred to as the “User” or “Client”) is required to read and comply with the provisions of these Terms and Conditions.
4. Matters related to the protection of personal data are regulated in a separate document – the Privacy Policy, which complies with Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR) and is available at: https://adr.ac/eng/gdpr.html. Acceptance of these Terms and Conditions is equivalent to acknowledging and accepting the Privacy Policy.
5. The Service Provider may be contacted via email at: info@adr.ac.
6. The Service Provider ensures accessibility of its services for persons with disabilities. Users who are unable to communicate electronically may contact the Service Provider by phone at: +31 6 40 66 85 05. To verify the identity of the caller and ensure data security, the Service Provider may ask for the email address associated with the user’s account or order.
§ 2. Definitions
• Training – an educational service in digital form (online course) offered for purchase through the Online Store.
• Online Store – the online shop available at adr.ac/pl/sklep.html, through which Clients may purchase Trainings.
• Moodle Platform – the e-learning system available at learn.hazmat.website, where purchased Trainings are made accessible.
• osTicket System – the support ticket system available at tickets.hazmat.website, used for handling service requests and technical support.
• Business Day – any day from Monday to Friday, excluding public holidays in the Netherlands.
§ 3. Purchasing Trainings via the Online Store
1. To purchase a Training from the Online Store, the Client must be at least 18 years old and be a citizen of a European Union Member State or an associated country (e.g. Switzerland, Norway).
2. Orders are placed by adding the selected Training to the shopping cart and completing the order form.
3. Providing personal data in the form is voluntary but necessary to process the order.
4. Access to the purchased Training on the Moodle Platform will be granted within 24 hours from the moment the payment is credited, with the time counted exclusively in Business Days.
5. Login credentials to the Moodle Platform (username and temporary password) will be sent to the Client electronically together with the VAT invoice.
6. If the Client wishes to receive a VAT invoice issued to a business entity, they must provide the full company name and VAT ID number either during the order process or in a separate email.
7. If the Training concludes with the issuance of a physical certificate, it will be shipped free of charge to an address within the European Union. For this purpose, the Client must provide the Service Provider with an accurate delivery address upon completion of the Training. Providing the address constitutes consent to share the data (name, surname, address, phone number) with the courier company performing the delivery.
8. The VAT invoice for the purchase of the Training is issued by default in electronic form and sent to the email address provided in the order form. If the Client requests a printed invoice, a paper copy will be included with the certificate shipment (if applicable). Such a request must be submitted by email after the purchase.
9. Payments in the Online Store are processed via an external payment service provider – Stripe, Inc. Personal data necessary to process the payment is transmitted directly to Stripe, which acts as an independent data controller. Stripe may transfer data outside the European Economic Area, including to the United States. Such transfers are carried out based on appropriate legal mechanisms, including standard contractual clauses approved by the European Commission, which ensure an adequate level of data protection. § 4. Right of Withdrawal from a Distance Contract
1. A Client who is a consumer has the right to withdraw from the Training purchase agreement without providing any reason, within 14 days from the date of its conclusion.
2. LOSS OF THE RIGHT OF WITHDRAWAL: In accordance with Article 16 letter (m) of Directive 2011/83/EU of the European Parliament and of the Council, the right of withdrawal does not apply to contracts for the supply of digital content which is not supplied on a tangible medium.
3. By placing an order, the Client gives explicit consent for the service (access to the Training) to begin before the end of the withdrawal period. The Client acknowledges that by logging into the Moodle Platform for the first time and accessing the training materials, they lose the right to withdraw from the agreement.
§ 5. Terms of Use of the Moodle Platform (learn.hazmat.website)
1. Access to the Moodle Platform is available at learn.hazmat.website.
2. Upon first login, the system will require the User to change the temporary password and complete their profile with their full name and email address. This information is necessary for proper user identification and for issuing a certificate, if applicable.
3. The Service Provider informs that Users’ passwords are stored in an encrypted database, in accordance with best practices for data security and protection.
4. The Service Provider keeps a log of IP addresses of Users logging into the Moodle Platform for security purposes and to monitor potential misuse.
5. The time limit for completing the purchased Training is:
• 60 days for individual Clients (private persons);
• 30 days for Users within corporate training programs.
The time is counted from the date access is granted. It is possible to extend access free of charge upon prior request to the Service Provider.
6. Upon completion of the training, the User’s account and the data associated with it are stored for a period of 5 years. This results from the legitimate interest of both the Service Provider and the User, namely the ability to reissue a certificate in the future. The legal basis for processing personal data after the provision of the service has ended is Article 6(1)(c) of the GDPR (legal obligation of the controller) and Article 6(1)(f) of the GDPR (legitimate interest of the controller).
7. It is prohibited to use the Moodle Platform in a manner contrary to the law or these Terms and Conditions, in particular:
• placing excessive load on the servers;
• posting content that is unlawful, offensive, or infringes on the rights of third parties;
• attempting to gain unauthorized access to system resources.
§ 6. Terms of Use of the osTicket System (tickets.hazmat.website)
1. The osTicket System is used for handling support requests and communication within ongoing cooperation or technical support.
2. An account in the osTicket System is created exclusively for Clients with whom the Service Provider has entered into a cooperation agreement, and only with their explicit consent. The account maintenance service is free of charge.
3. Upon the Client’s request, the Service Provider may enable two-factor authentication (2FA) for the account, using a code generated by an authenticator app (a 6-digit code valid for 30 seconds).
4. The Service Provider logs the IP addresses of Users accessing the osTicket System for security purposes.
5. It is prohibited to use the osTicket System for purposes inconsistent with its intended function, including sending spam, posting illegal content, or placing excessive load on the servers.
§ 7. Intellectual Property
1. All content, educational materials, graphics, videos, and texts made available as part of the Trainings on the Moodle Platform constitute the exclusive intellectual property of the Service Provider and are protected by copyright law.
2. The User is granted only a license to use the training materials for personal, non-commercial purposes.
3. The following actions are strictly prohibited:
• sharing login credentials to the Moodle Platform with third parties;
• copying, reproducing, distributing, selling, or otherwise commercially exploiting the training materials, in whole or in part;
• publicly playing or displaying the contents of the Training.
4. Violation of the provisions concerning intellectual property may result in immediate suspension of access to services and the initiation of legal action to pursue claims for damages.
§ 8. Complaint Procedure
1. The User has the right to submit complaints regarding the functioning of the Services and the quality of the services provided.
2. Complaints should be submitted electronically to the following email address: info@adr.ac.
3. A properly submitted complaint should include at least the full name (or company name), email address, and a detailed description of the issue.
4. The Service Provider will review the complaint within 14 Business Days from the date of receipt and will inform the User of the outcome.
§ 9. Final Provisions
1. In matters not regulated by these Terms and Conditions, the relevant provisions of Dutch law shall apply.
2. Any disputes arising from the performance of agreements concluded under these Terms and Conditions shall be resolved by the court having jurisdiction over the registered office of the Service Provider.
3. The Service Provider reserves the right to amend these Terms and Conditions. Users with an active account will be informed of any changes by electronic means. Changes will take effect on the date specified by the Service Provider, but not earlier than 7 days after being announced.
